Privacy Policy
This policy explains what information Fishlert Inc. (“Fishlert”, “we”) collects, how we use it, who we share it with, and your rights. If anything is unclear, email hello@fishlert.com. The defined SMS terms (“Partner”, “Buyer”, “Opt-In Request”) used below match our Terms of Service.
1. What we collect
- Waitlist signups: name, email, phone, role, company, location, and anything you tell us by SMS in response to our survey.
- Newsletter subscribers: email address and (optional) name.
- Outreach contacts: business email and company information sourced from public business directories, used strictly to offer access to the Fishlert waitlist. We honor opt-outs immediately.
- Partner accounts (seafood distributors, harbormasters, or fishermen who use Fishlert to broadcast catch alerts): business name, contact name, business phone, and the IP address + timestamp of every Terms+Privacy acceptance event.
- Buyer SMS records: phone number, optional name and company, the exact consent attestation text that was on screen at the moment you opted in, the IP address that captured your consent (where applicable), the Twilio message identifier of your opt-in reply, and the contents and delivery status of every SMS sent between you and a Partner through Fishlert.
- Site analytics: Vercel Analytics aggregated page-view data — no cookies, no cross-site tracking.
2. How we use it
- Confirm your waitlist signup and send you product updates.
- For SMS Buyers: deliver an opt-in REQUEST message naming the Partner who added you, deliver catch-availability alerts only after you have replied YES, deliver Partner replies and confirmations, and act immediately on STOP / unsubscribe replies.
- For Partners: process catches you text in, broadcast to your opted-in Buyers, collect their replies, and present a roll-up so you can close deals.
- Email our weekly seafood industry newsletter to opt-in subscribers.
- Contact businesses we believe are a fit for Fishlert with a single offer to join the waitlist. We honor opt-outs immediately.
- Maintain TCPA / consent audit logs that record every opt-in event, the verbatim attestation text the user agreed to, every opt-out, and every catch-alert that was skipped because the Buyer had not opted in.
- Diagnose issues and improve the service.
3. SMS / TCPA specifics
Fishlert is the platform that delivers SMS on behalf of Partners. By design, no marketing or catch-availability message is ever sent to a Buyer until that Buyer has affirmatively opted in. Opt-in is captured one of four ways:
- SMS reply YES — you texted a Partner’s number (or were sent an Opt-In Request) and replied YES, Y, OK, CONFIRM, or JOIN.
- Web signup inline — you ticked a consent checkbox on a public form whose text matched what is stored on your record.
- Partner attestation on file — the Partner has provided Fishlert a written attestation that they hold prior express consent from you (typically because you have purchased from them before and gave them your number for catch alerts). In this case the Partner’s attestation text is stored on your record alongside the timestamp and the staff member who recorded it.
- Grandfathered — you were on a pre-flip system before Fishlert tightened these requirements. New Buyers do not enter this state.
STOP (and STOPALL, QUIT, END, CANCEL, UNSUBSCRIBE, REVOKE) at any time stops all further messages from that Partner via Fishlert and is logged as a consent withdrawal. While you are in the pending-opt-in window, NO (and NOPE, NAH, DECLINE) also count as a decline. Message and data rates may apply. Message frequency varies.
Fishlert marketplace feed. We also operate a unified feed at our main number (+1 978 338 7372). Subscribing to the feed means you receive offers from every CURRENT Fishlert partner seller in a single SMS thread; the opt-in copy at the time names every partner explicitly. Each offer in the feed identifies the selling partner and includes their direct number so you can text them 1:1 if you want a personal relationship. We may add new partner sellers over time; you can leave the feed anytime by replying STOP to that number, separately from any direct partner subscriptions you also hold.
4. Who we share it with
We use a small number of service providers who process data on our behalf:
- Supabase — database and storage.
- Resend — transactional and newsletter email delivery.
- Twilio — SMS delivery (subject to Twilio’s own privacy practices and US carrier requirements).
- Vercel — site hosting and aggregate page-view analytics.
- Anthropic — AI parsing of catch-text and conversational SMS replies. Personal data is minimised; phone numbers are not sent.
We share Buyer information with the Partner who added you so they can fulfil orders — that is the point of the service. We do not sell your data, we do not share it with advertisers, and we do not run ad pixels. We will disclose data when legally required (subpoena, court order) and notify you if not prohibited from doing so.
5. Your rights
- Unsubscribe from email at any time via the link in every message, or at fishlert.com/unsubscribe.
- Stop SMS by replying STOP to any Fishlert message. Carrier-level STOP is also honored automatically.
- Access, correct, or delete your data: email hello@fishlert.com and we’ll respond within 30 days. We may retain a consent / opt-out audit record after deletion of other fields where required to demonstrate compliance.
- If you’re in the EU/UK you have additional rights under GDPR (portability, restriction, objection). If you’re in California you have additional rights under the CCPA / CPRA (right to know, delete, opt-out of sale — note we do not sell personal information). Same email works.
6. Retention
We keep waitlist and subscriber data until you ask us to delete it or until we no longer need it. For SMS: opt-in / opt-out audit records (timestamp, method, attestation text, message identifiers) are retained for at least four years to comply with TCPA recordkeeping; the body of individual messages is retained for as long as your Partner needs it to run the service. Email suppression records are kept indefinitely to ensure we don’t email you again after you’ve opted out.
7. Security
Data is stored in encrypted Supabase Postgres and transmitted over TLS. Administrative access is restricted to a small team using shared credentials managed in an environment vault. We do not store payment information.
8. Children
Fishlert is a B2B service. We do not knowingly collect personal information from anyone under 18. If you believe we have, contact us at hello@fishlert.com and we will delete it.
9. Changes to this policy
When we change this policy in a way that affects your rights we bump the version shown at the top of this page. Partners using the SMS platform will be asked to re-record their acceptance against the new version before sending further blasts.
